Summary of Eagle Point Covenants/Deed Restrictions

Construction Process for a Single Family dwelling unit:

Initial Review shall include:

  1. Clearing and Grading Plan
  2. Landscaping plan with existing tree survey.
  3. Dimensioned site plan schematic.
  4. Floor plan and elevations.
  5. Specifications including exterior material and colors.

Final Review shall include:

  1. Clearing and Grading Plan
  2. Landscaping plan with existing tree survey.
  3. Dimensioned site plan schematic.
  4. Floor plan and elevations.
  5. Specifications including exterior material and colors.
  6. Irrigation design.

Also prior to start of construction a copy of the building permit must be submitted to ARC.

Dwelling size

  • Lots 1 thru 11 and Lots 17 thru 27 – 1500 sq. ft.
  • Lots 12 thru 16 – 2000 sq. ft.
  • Lots T1 thru T4 – 1500 sq. ft.

Construction setbacks:

Lots 1 through 27 (Eagle Point Subdivision)

  • Front/road 30’ from ROW (except lot 27 which is 25’)
  • Side property line 10’
  • Rear Property line 50’ (except lots 25, 26 & 27 which is 25’)

Lots T1 through T4 (Trinity Trail Subdivision)

  • Front/road 30’ from ROW
  • Side property line 5’
  • Rear Property line 50’

Single Family Home Requirements

  • Contractors must be a State of Florida licensed builder.
  • Roof to have minimum 6-12 pitch.
  • Architectural grade shingle roofs.
  • Roofs should have a minimum overhang of 1’-6” on the eave and 12” on the gable ends.
  • All exterior wall surfaces shall be either brick, stucco, wood or stone. No painted block.
  • Normal construction hours are between 7:00 a.m. to 8:00 p.m.

Garage

  • Minimum 2 car but no more than 4 car garage plus storage.
  • Front Garage Doors shall be side entry when possible except Lots 1 thru 11 and 17 thru 27.
  • Automatic garage door opener required.
  • Service door required.
  • Concrete driveways only.
  • May not be converted into an additional room or apartment.
  • Screening of garage doors is not permitted.

Allowed Additional Structures (All structures must have ARC approval)

  • Single level storage shed (maximum 10’ x 15’).
  • Lots T1 thru T4.
  • Lots 1 thru 11.
  • Not allowed on Lots 12 thru 19.
  • Lots 20 thru 27.
  • No metal, runner, plastic or vinyl exterior materials allowed.  Shingle roofs required and match the color of the residence.  Landscape along the front and side.
  • Docks, covered slip, davit or ramps.
  • Below ground swimming pools and screened structures.
  • Cabanas and gazebos.

Fence

  • Cannot extend towards the road beyond the rear corners of the house excluding porches.
  • Lots 1 thru 11 and T1 thru t4 – Maximum height is 6’ and may extend no closer than within 25’ of canal.
  • Lots 12 thru 20 – No fences are allowed.
  • Lots 21 thru 27 – Maximum height is 4’ except within 75’ of canal where it is 3’.
  • No chain link fences are allowed on any lot.

Hedges

  • Lots 1 thru 11 and T1 thru T4 – Parallel to and along the canal – maximum height is unlimited and may extend no closer than within 8’ of canal.
  • Lots 12 thru 20 – Maximum height is 4’ except within 75’ of canal where it is 3’
  • Lots 21 thru 27 – Maximum height is 4’ except within 75’ of canal where it is 3’.

Landscaping

  • All garage & trash storage areas and air conditioner compressors shall be screened.
  • No clothes line or clothes poles or mechanism for hanging of clothes.
  •  Yards must be sodded with St Augustine or Bahia grass.
  • Approve by ARC of all trees greater than 4” in diameter at breast height before cutting.
  • Each lot must have an underground irrigation system.
  • Landscape plans must be submitted and approved.
  • Rear lot line drainage swale 25 feet from and parallel to the canals and lake shore on all lots must be maintained per St John River Water Management District.
  • 15’ wide permanent vegetative buffer along all water lots must be maintained with a dense vegetative cover.
  • Each lot shall be maintained in good appearance and free from overgrown weeds, dead trees, fallen tree limbs, untrimmed trees and rubbish.

Miscellaneous Items

  • No commercial or business activity on any lot or structure except a home office.
  • No visiting home business clients/traffic.
  • No carports.
  • No spotlights, floodlights or similar high intensity lighting can shine on any other lot or improvements thereon without ARC approval.
  • No aluminum foil or reflective surfaces shall be placed in any windows.
  • No window air conditioner units without ARC approval.
  • No television antennas or reception dishes will be permitted except for dishes less than 18” in diameter.
  • No above ground fuel or gas storage tanks unless approved and in buildable area and screened.
  • No construction materials or equipment are to be stored on any lot.
  • No clotheslines or clothes poles on any lot.
  • No above ground pools.
  • Window and porch screening shall be white, bronze or other approved color.  No mill finish aluminum.
  • Solar hot water heating systems and piping must be approved by the ARC.
  • Fixed game and play structures shall be installed or used only in the rear of a dwelling unit and not exposed to view from any public or private street.
  • Location of basketball backboards must be approved by the ARC.
  • No business vans/trucks over 3/4 ton or tractors.
  • No unlicensed, stripped, wrecked or unsightly vehicles shall be stored on any lot.
  • No outside storage of boats (not moored to a dock/slip) and trailers.
  • No campers, recreational vehicles or RV/mobile home trailers except for a short duration of several days.
  • No vehicles (three/four wheelers, two wheel dirt bikes or all-terrain vehicles) shall be operated within a property.
  • No long term tents/canopies (allowed for temporary social functions only).
  • One estate sale per lot and 2 Association sponsored garage sales are allowed per year.
  • No signs allowed except a real estate sign (not larger than 4 square feet and not higher than 5’).
  • No soliciting.

Animals

  • Birds, fish, cats and dogs shall be permitted with a maximum of 3 pets per lot (other than fish & birds) and no more than 2 of them may be dogs.
  • Loud or persistent barking by dogs is not allowed.
  • Domestic pets shall not be allowed in areas which are not fully enclosed by a fence, and must be on a leash or accompanied by a person.
  • No animals, livestock or poultry of any kind shall be raised, bred or kept on any lot/dwelling unit.
  • No Pit bull dogs are allowed.
  • Exterior dog houses, bird baths and pole mounted birdhouses shall be approved by the AC.

Rentals/Leases

House rentals/leases are limited to a minimum of six months with no more than two renter/leases in a calendar year.
